Creditor Misconduct in Essex County
When you are struggling with debt, creditors will do whatever it takes to get you to make payments. It can be hard to know exactly what to believe. As a result, many creditors give people misinformation and take advantage of consumers who are just trying to get back on their feet.
I am Lynn lawyer for unfair debt collection cases David McLoon and for more than 25 years, I have been helping people like you take a stand against creditor misconduct while working to get the debt relief they deserve. If your creditors break the rules and try to take advantage of you, we will go after them and seek damages.
Do Not Let Your Creditors Take Advantage of You
There are a number of laws, both federal and here in Massachusetts, designed to protect consumers dealing with creditors, including the Fair Debt Collection Practices Act, the Unfair Trade Practices Act and the Truth in Lending Act. The automatic stay that is written into the bankruptcy process is also designed to protect consumers.
As soon as you retain me as your attorney, even before you file for bankruptcy, debt collectors are no longer supposed to contact you directly. Doing so is a direct violation of the Fair Debt Collection Practices Act. If your creditors have started the repossession process, I may be able to stop it, if you contact me early enough.
Wage garnishment must be stopped as soon as you file for bankruptcy. If your creditors continue to garnish your wages, we can go after them for damages beyond the wages you have lost for this violation.
